Eleview Client Data Policy
Policy re Transaction Data
Eleview considers commodity transaction data provided to
Eleview under an Eleview Service Agreement ("Client
Data") to be the confidential information of the client
that provides it ("Source Client"). Eleview will
take appropriate precautions to ensure the privacy of Client
Data and will disclose Client Data only to:

the Source Client; |

The
producer identified in Client Data as party to the transaction; |

• |
Commodity,
industry or government organization(s) but only as authorized
by Source Client or as required
to fulfill the reporting obligations of Source Client
which the organization is entitled to require under
applicable legislation. |
Eleview will otherwise use
Client Data only to calculate statistics based on the aggregation
of Client Data with similar data of other Eleview clients
so that the resulting "Statistical Data" is anonymous
as to source. Eleview may disclose Statistical Data to any
Eleview Clients.
NOTE regarding the Direct Debit Program:
Transaction data reported to Eleview is not provided to ACC Farmer's Financial
unless 1. the reporter has signed a Service Agreement with Eleview for that purpose
and 2. the transaction data involves an active loan client of ACC's.
Policy re Lien Data
Eleview Clients ("Lenders")
providing credit or crop purchase advances or loans to producers
("Debtors") may contract with Eleview to provide
"Lien Data" to Eleview which Eleview will in turn
make available to other Eleview clients as set out below.
Lenders are responsible under the
Eleview Service Agreement
for the accuracy of Lien Data they provide and are responsible
for ensuring that the lien status is promptly updated in
the event a lien is fully satisfied or the portion of a
lien pertaining to any listed crop is fully satisfied.
Lien Data shall include, among other data, the name and
address of the Lender and Debtor(s) and associated crops
and repayment rates. Lien Data shall not include the amount
of any outstanding debt. Lien Data shall only be displayed
for liens that the Lender has not advised Eleview are fully
satisfied.
For any given lien, Eleview
may make Lien Data available only to:

The
debtor(s) listed. |

2) |
The
lender or employee of the lender or other party designated
in writing by the lender. |

3) |
Any third parties that may act as a buyer or agent of
a buyer for a crop or may reasonably be judged to be
in the business of lending funds to parties such as
the debtor. |
Data Access and Security
Eleview will make data available
to authorized Clients as defined above during operating
hours via a secure Web access. Eleview will use industry
accepted security practices and take commercially reasonable
precautions to ensure that Client Data is not accessible
by unauthorized parties and is recoverable in the event
of disaster or systems failure.
